When It Happens At the Scene

Do the best you can.  If you are not too badly hurt, here’s what you need to do.

  1. Police: Call the police even if it appears that there is little property damage or you don’t think you are hurt that bad. And make sure to get the report number.
  2. Photos: Take a bunch of photos or have someone else if you cannot.
  3. Witnesses: Get names and numbers if possible. If you can’t, ask someone else to do so.
  4. Attitude: Yes, you are hurt, and yes, you are pissed off, but don’t get angry and don’t threaten anyone. Sure, the person that hit you did something stupid that has hurt you and totaled your bike, but that person did not (hopefully) intend to do so.
  5. If you get angry, and there is any question as to whose fault the collision is, your anger could burn you, especially when talking with the police officer, whose report can be all important in determining liability. You don’t want to get pissy with the police officer.
  6. Emergency Care: If there is a question regarding whether to go to the ER, opt to go. Cyclists have this tendency to shake off the injuries; however, after the adrenaline drops, you will probably start hurting more. If you hit your head or your head hurts, go to the hospital, no question about it.
  7. Call Us: The sooner we get your call, the better job we can do for you. We can relieve you of the burden of making the claim(s) with the insurance companies. We can also assist you in obtaining prompt, follow-up medical care.

A Few Days Later: Evidence, Medical Care, Lost Income

  1. Evidence: Get these documents or information if possible:
  2. Police Report: Request it from the appropriate authority. (It can take a week or so to get it.)
  3. Witnesses: If you didn’t get any witnesses’ names at the scene, there might be some on the police report. You can also request the 911 call from the local authorities, and that may have some helpful information. (You do that through a Freedom of Information Act or “FOIA” request.) 
  4. Photos: Take pictures of everything – bike, clothes, your body, the accident scene. Keep taking pictures of your injuries and wounds at various intervals. Those can be very helpful later.
  5. Garmin Data: Determine if it is helpful or not. Do not post it to Strava, and be very careful about posting on social media sites.
  6. Property Damage: Get a detailed estimate to repair/replace your bike/clothing from your local bike shop.
  7. Follow-Up Medical Care: Don’t delay treatment. Even if you don’t think you are hurt too bad, it is still wise to see your preferred provider. Delay can be used against you to argue that your injuries weren’t that severe.

If your preferred provider is an M.D., don’t be surprised if they give you the song and dance of “we don’t treat people involved in auto accidents.”  You might have to call another doctor’s office.  (I’d estimate that 25% of my clients tell me that their own doctor will not treat those injured in auto accidents.)

Lost Income:  If you are going to be out of work or will lose income because of your injuries, start keeping track of the amount lost. You must be fastidious in doing so; include date, reason, hours, etc. With some employment, it is difficult to prove wage loss, such as with commission sales or self-employment. Nonetheless, try to keep track of all data regarding lost sales, missed bids, bonuses, etc.
